ROLE AND REALITY OF THE COMPETITION LAW IN MALAYSIA: ARE YOU A DUCK OR AN EAGLE?

Abstract

Competition law is officially commenced in Malaysia with the passing of the Competition Act 2010. With the rising complaints accumulated, it certainly shows that the society is being more aware of the positive impacts and their rights provided by the competition law. Other than the public awareness, the awareness among the business competitors is also discussed to understand the way of maintaining a healthy competitive market. The implementation of this new area of law has indeed brought several benefits to the society directly or indirectly. The statutes regarding the competition law is critically analysed and the operation of this law is the spotlight of the discussion together with its aftermath. Landmark cases and the effects of the competition law towards Malaysian economy will also be discussed. Decisions by the Competition Commission are being interpreted from the economic aspect to understand the growth of the execution of the Competition Commission. Recommendations are provided for the purpose of enforcing the competition law practically, based on the findings that have been collected. The efforts by the Competition Commission in trying to include merger control and acquisition as part of the competition law can be clearly seen. Public awareness shall also be increased in order to develop a positive and effective competing society.
