AS AI EVOLVES, SO MUST THE LAW: LEGALGAPS, ETHICAL DILEMMAS, AND THE WAYFORWARD

Abstract


Artificial Intelligence (AI) is rapidly transforming various sectors globally and in Malaysia, including industry, commerce and new energy conversion. While AI offers immense benefits, it also raises critical legal and ethical concerns such as legal entity, accountability gaps, and misinformation. Malaysia’s current legal framework lacks the specification and scope needed to address the unique challenges posed by AI. This article argues for the urgent need to establish a structured and comprehensive legal framework for AI governance in Malaysia by analyzing existing legal instruments and policy initiatives. The article then explores three key legal issues: the issue of AI personhood and liability in autonomous decision-making, the rise of deepfake and defamation, and intellectual property rights over AI-generated content. Each issue is analyzed through real-life incidents and evaluated within the context of Malaysian law, with references to legal frameworks from other countries. Identify the specific countries used for benchmarking as international comparisons are mentioned for comparison. The discussion underscores the legal ambiguity and the risks of regulatory fragmentation. Finally, the article proposes practical recommendations and emphasizes the need for proactive legal reforms to ensure Malaysia remains competitive, ethically grounded, and rights-conscious in the evolving AI landscape.
