CYBERBULLYING AND DIGITAL HARASSMENT: IS MALAYSIA’S LEGAL FRAMEWORK ADEQUATE?

Abstract


As digital platforms increasingly shape the fabric of modern communication, Malaysia faces a crisis: a sharp rise in cybercrimes following the escalation of online interactions, specifically cyberbullying and digital harassment. Against this backdrop, this called into question the adequacy of the legal framework, including the CMA, CCA and the Penal Code. Not only the legislation, but also the enforcement practices, which are anchored by the increasing incidents, are proven to be insufficient and have led to public outcry. This emphasised the necessity to revisit the limitations of the current law and enforcement

practices in tackling such threats. Drawing on comparative insights from the UK’s Online Safety Act and Singapore’s Protection from Harassment Act, the paper aims to offer a holistic and forward-thinking approach to reclaim the internet as a safe space for all.
